breaking news: PNP’s Razon: “Lozada (ZTE witness) in our custody”

Breaking news: 15 minutes ago, PNP Director General Avelino Razon said they had custody of Senate witness Rodolfo “Jun” Lozada  when asked by DZMM anchors Ted Failon and Korina Sanchez to confirm the identity of the PNP police personnel who took Lozada yesterday.

     (the family now refuses to  talk about the incident.  With this confirmation by PNP Director General Avelino Razon, the Senate security personnel should now go to Camp Crame where Avelino Razon at this very moment is delivering a speech, to serve the warrant of arrest on Razon, who has confirmed custody of the witness subject of the warrant of arrest. The senators can directly ask Razon to disclose the location of the witness in order that the Senate can take custody of him. Razon said he was in the custody of the PNP Police Security and Protection Group. Since Lozada is subject of an arrest warrant, those who have custody of him, e.g., Razon, can be compelled by the Senate to immediately disclose his location.)

“May kumuha sa akin” (“some people took me”)- Rodolfo “Jun” Lozada (direct witness to ZTE contract- negotiations)

“Nandito ako sa departure area, may kumuha sa akin” (i’m here at the departure area, some people took me away”) was one of the last text messages that witness Rodolfo “Jun” Lozada was able to send his brother an hour ago.

       They took him; spirited away by “unknown men” when he stepped on the tarmac of the NAIA (airport) an hour ago; these men are powerful enough or have enough authorization to be standing at the airport tarmac waiting for him.  Rodolfo “Jun” Lozada  is now being denied access to his own cellphone, is being deprived of his liberty, held against his will, his family members interviewed on DZMM are looking for him, the Senate security members who were supposed to take him into custody on the strength of a Senate arrest warrant, are looking for him and,  if DZMM reports are accurate, presently chasing the vehicle that whisked him away.   

         Rodolfo “Jun” Lozada is a  technical consultant on IT matters of  then NEDA secretary-general Romulo Neri.  A couple of years ago, Mr. Neri asked him to assist him in evaluating the ZTE contract and  in which capacity he joined the trips to China. If the information of Joey de Venecia is accurate, he  has  direct and personal knowledge of how $200 million in commissions changed hands during the contract- negotiation of the ZTE broadband deal.  He left for Hongkong or London last week and came back today.      

      His passage thru the airport was under the supervision of General Angel  Atutubo, Deputy Chief  of airport security. According to witnesses, he was the person last seen with Mr. Lozada. 

      What is the  number of General Atutubo and if true, upon whose orders was Mr. Lozada taken? Is Atutubo  still part of the AFP command structure and therefore under the command of Esperon  or, being airport security and civilian, is he under the control and supervision of the Bureau of Immigration and Bureau of Customs?    

         If the reports are true, those who have custody of Rodolfo  “Jun” Lozada against his will  and all those who ordered this operation , if private persons or non-police, are presently committing  or can be charged with illegal detention or, if accompanied with threats against the life of the person ,kidnapping; grave coercion; obstruction of justice. If those who have custodyof him against his will are public officers, they can be charged with arbitrary detention, grave coercion, obstruction of justice.  

    Surface  Rodolfo “Jun” Lozada and return him to his family now.

     (family members and friends of Mr. Lozada  who may have any contacts in the airport security staff or the PSG or immigration: Now is the time to use those contacts  and activate a silent search; the longer it takes, the more remote the probability becomes of locating the person. The legal remedy is to immediately execute affidavits, for those who last communicated with Mr. Lozada  or those who last saw him, stating the facts and the persons who have control and supervision of his passage thru the airport; and file a petition for the privilege of the writ of habeas corpus before  a Pasay city court, or the CA or the SC, naming those persons who have control of his passage thru the airport, and  all their  superiors and principal; then talk to the executive judge or the Clerk of Court  on the urgency of the matter so it could be calendared and heard on the same day tomorrow. The Senate, which issued the warrant of arrest on the other hand can try locate the persons last seen with Mr. Lozada, e.g., airport security, and ask them to surface the witness; if the Senate security has reasonable ground to believe that he is being kept in any enclosure, they can use reasonable force to break into such enclosure to effect the arrest and take custody of Mr. Lozada.)

     The phone was in my right hand and the wheel was on my left, this was like 8:30 am  yesterday and i was on hold so i tried to press speaker looking straight ahead then the line was gone, i had pressed the red icon instead. Apologies:  to the number one radio morning program multi-awarded nearing hall of fame: Sorry po (i heard they were calling out my name on air, and i  heard  i was introduced as  “political analyst”, the first time anyone’s called me that because i don’t consider myself  one, ha-ha.  Anyway. Sorry talaga) and also to the  producers: the phone number did not register in my cellphone  (after my  line went dead i texted the earlier number instead but i guess they were in another room.) And that was how my phone-patched interview on the speakership row went yesterday morning.  I was never able to return-call the entire day because of the jumbled-up sked too.     

     Anyway. I wrote a little something for you. (but i swear, this is the last time i’m going to write about their political intramurals.) I saw the killing.     

       The title: Lick Your Wounds and Regroup      

     After  having unknowingly drank the poison at her table, feeling his intestines burning, then suffering a dagger at his back with her initials, going out on the street and being hurtled a hundred feet  by her speeding truck, then landing on her booby trap of rusty iron bars, he staggered to get up and said, “I think she’s trying to kill me.”    

         It was supposed to be JDV’s valedictory at the House, but it became a call to war, the “peacemaker” realized he had to fight, but realized it too late, his army had been halved, there was little he could do, and he was too bloodied.      

     Holding  just one-fourth sheet of a yellow pad paper (what was that, his outline? A list of crimes? must have been in microscopic print. Or a suicide note? Only time, three or five months, will tell), he delivered an extemporaneous one-hour  speech: he told of murder or murder plots, of his knowledge of “attempts” by Gloria Macapagal Arroyo to change the results of the 2004 presidential elections (this better be personal knowledge), of pork barrel being centralized by Gloria and how congressmen have to beg on their knees before the Arroyo sons to get their share.     

     JDV yesterday evening fought from his guts, he was never prepared, and he lost this battle.    

        They started killing him last year, the pork barrel was centralized, the death blow was set in motion when the Blue Ribbon Committee chair gave the Arroyos time to rest by suspending the ZTE investigation, the impeachment complaint was filed and dismissed setting the one-year bar. Those were his best weapons, the impeachment was then within his control, being Speaker and majority party stalwart. He was being disarmed  yet  he did not know when to make a break because he refused to look at the faces of his enemies, and therefore could not recognize them, could not tell,  they were closest.  When your enemy tells you something, do not believe it. JDV expected mercy and got a swift death.    

        Time is not on JDV’s side. In five months, the election year will be set in motion.      

      Lick your wounds and raise your army, if you’re going to do something, do it quickly.      

      And most of all, JDV has to learn, now that he is no longer Speaker. When the impeachment year was open, he refused to bite the bullet  not  realizing a new government would give him comprehensive immunity and that history will kind be to those who tell all. You fight half-battles with half-confessions and you get death.      

     Let’s start with the full confessions, with checks,  bank accounts, documentary evidence. You either choose full confessions  and imagine a new  government or choose Gloria and  your oblivion.
