“No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. (Section 1, Art. III, 1987 Constitution)” I’d relate these to the long overdue issue on the overcrowding jail situation in the Philippines.
Over the years, a few articles have featured this issue and it remains to exist today. A family member working in Manila City Hall recently expressed her concern over this issue as inmates crowd the lobby half-naked and covered in their own urine. They are treated as if they are animals and wouldn’t even dare to ask authorities for better treatment.

Taal Volcano spewed ash up to nine miles into the air last January 13, 2020 prmpting warnings of possible “explosive eruption”. Phivolcs raised the status to Alert Level 4 due to continuous eruption that carried until the following day.
On January 15, 2020, President Rodrigo Duterte declared the island volcano to be off limits for safety measures. The President also ordered the Philippine National Police (PNP) to halt people from going to Taal. The Department of Health (DOH) was ordered by the President to provide face masks and health assistance to those who are in the affected areas.
The President as Chief Executive directed certain government agencies that execute Section 17, Article VII of the 1987 Constitution: “The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed.”
The anti-narcotic campaign of the Duterte administration for the past years is still one of the concerns of the human rights advocates not just within the country but also in the international organizations and councils.

Last January 12, 2020, one of the most active volcanos in the Philippines had erupted and continued to spew plume of ashes for weeks with an approximate 15km high which resulted in large-scale evacuation within the affected zones and nearby areas. The government issued an assistant package for the people who are affected in the Taal eruption, including the farmers and fisherfolks.

In the said news this can fall to Section 17, Article VII of the 1987 Constitution which declares that “The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed.”
Constitutional law principle described: No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. (Section 1, Art. III, 1987 Constitution)
Retried Army general Jovito Palparan Jr. was found guilty of kidnapping and illegally detaining UP students Karen Empeño and Sherlyn Cadapan in 2006. He was sentenced to reclusion perpetua and was asked to pay moral damages for each count.
By abducting and detaining Empeño and Cadapan without due process of the law, he deprived them of their right to liberty and violated their constitutional right to a fair trial before being detained. As chief of the Intelligence Service of the Armed Forces of the Philippines at the time, Palparan baselessly and illegally detained the two UP students who are still missing to this day. He used his position as an AFP official under the leniency of the Arroyo administration to execute extrajudicial powers in illegally detaining those he deemed as rebels against the government. However, despite being an army official, this does not give him and his other accomplices the power to ignore the right to due process.
In class, I also learned that AFP officials cannot decide on a whim whether to arrest or abduct anyone they suspect to be ‘rebellious.’ If we are to follow due process, the court must first give out a notice of hearing before the person can be arrested. This is part of the constitutional law principle that no person shall be denied the equal protection of the law, as everyone under the eyes of the law is equal.
According to a report by “Rappler in 2019, 93% of Filipinos want PH to regain China-occupied islands”. It is said through a SWS survey that 93% of Filipino adults say “it is important that the Philippines regain control of the islands occupied by China in the West Philippine Sea.” Which is more than the 89% that agreed in the past year. This news illustrates Section I, Article II: Declaration of Principles and State Policies of the 1987 Constitution which states that “The Philippines is a democratic and republican State. Sovereignty resides in the people and all government authority emanates from them.” The survey shows that most of the Filipinos wants to regain China-occupied islands, which is within our exclusive economic zone. Despite the Hague ruling, it seems nothing has happened. The government doesn’t do anything as China continues to build upon these islands. The people should demand it government as it is their right and their sovereignty.
I learned in class that the Filipino people doesn’t exercise this right vigorously, it only seems that the Filipino’s sovereignty operates only when the people act as a political body, during elections, when we choose and elect their government officials and representatives. Nothing more.

“No person shall be deprived of life, liberty, or poverty without due process of law, nor shall any person be denied the equal protection of the laws.” (Section 1, Art. III, 1987 Constitution)
Every Filipino has the fundamental right of being guaranteed due process. This legal concept may be exemplified through the Congress pressing to look into the extrajudicial killings that have occurred due to Duterte’s ‘war on drugs’. Ifugao Rep. Teddy Baguilat cites Article III, Section 1 of the Constitution as stated above, for several persons suspected to be violating laws against illegal drugs were killed by law enforcers under vague circumstances (Cayabyab, 2016).
I have learned in class that it is the right of every Filipino to be given due process and a court-issued warrant of arrest is needed in order to detain someone. With this in mind, the news event cited above is a violation of the constitutional right of those affected by the president’s ‘war on drugs’. This constitutional law principle was applied to this situation by the Congressman using the concept to emphasize the deprivation of this right by the Duterte administration.
“The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed”. (Section 17, Art. VII, 1987 Constitution)
President Duterte exercises law enforcement by declaring Taal Volcano Island as “no man’s land” in view of the hazards posed by the eruption of Taal Volcano. He approved recommendations made by the National Disaster Risk Reduction and Management Council (NDRRMC) and Philippine Institute of Volcanology and Seismology (Phivolcs) to declare so, aiming to ensure the people’s safety in case Taal Volcano erupts again in the future. Consequently, he applies this legal concept by ordering the Philippine National Police (PNP) to bar entry into the island (Carlos, 2020).
The Senate hearings on the prostitution dens of Philippine offshore gaming operators illustrate the constitutional principle, “No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. The government efforts to investigate and put an end to businesses trafficking and prostituting women and minors honor the constitution’s respect for life and liberty.

Philippines drug war: Police guilty of murdering Kian Delos Santos https://www.bbc.com/news/world-asia-46381697
Section 1, Article III of the Constitution states “No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws.” The provision speaks of “due process” and “equal protection.”
Due to President Duterte’s war on drugs, Kian Delos Santos is the very epitome of what is wrong about not having the due process of law. According to the news article “5,000 dealers or users have been killed, according to police” since 2016. Of all those, how many could have been innocent or could have changed for the better? But does it even matter who really are the dealers or users of drugs? To the eyes of the Filipinos, who most of them are poor and those who fight for these people, this is war on the poor. It’s not right to take life even if proven guilty thus what more on the innocent? Justice is based on consequence and this is not justice at all even if it’s about drugs, life is so much more important because I believe that people are capable of change when given a chance, when given rehab, and when they are given help, and not a choice of death. Kian Delos Santos, whose soul may rest in peace and power, could have been one of those Filipinos who could have made a change.
Section 17. The President shall have control of all the executive departments, bureaus, and offices. … The President shall be the Commander-in-Chief of all armed forces of the Philippines and whenever it becomes necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion or rebellion.
Because of his order to evacuate everyone on the island, there is a 100% assurance that no looting would be done because of an urgent matter by setting it as off-limits for the safety of everyone. The urgency to evacuate people gives a strong impression that it isn’t safe to be within the vicinity thus giving people the idea that even to loot or cause trouble wouldn’t be a good idea.
According to a report by “Rappler in 2019, 93% of Filipinos want PH to regain China-occupied islands”. The article talks about how majority of Filipinos think that many human rights are being violated through the War on Drugs.
“ The December 2019 survey results released late Sunday, January 12, showed that 33% of Filipinos said that the abuses are “very many” while 42% said “somewhat many” – totaling 76% for “many.”
The respondents were asked: “In the course of the administration’s war on illegal drugs, would you say that the number of abuses of human rights, for example the Extrajudicial Killings or EJKs, has been… (Very many, Somewhat many, Only a few, or Very few)?”
At least 24% said there were few – 21% only a few and 3% very few.”
The legal concept that is involved in this news report is the Section 1, Article III of the 1987 Constitution: “No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws.”
“No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. (Section 1, Art. III, 1987 Constitution)”
In the article, two gunmen riding a motorcycle killed a policeman at the national highway of Barangay Tapon Norte in San Jose. The suspects took the life of Police Executive Master Sergeant Roldan Esmajer by their own hands, clearly violating Section 1 Article III of the Constitution. It should be just then to investigate the murder, find the two suspects and test them before the courts.
I learned that although there are plenty of cases of tokhang and extrajudicial killings, it can also go the other way. Police and government officials like regular citizens, also have their rights.

“The VFA is seen as a reaffirmation of the obligations of the Philippines and US under the 1951 Mutual Defense Treaty, which mandates both countries to support each other in case of an external aggression.”
Visiting forces agreement solidifies American defense support should the Philippines face any form of conflict, in light of Bato’s US visa termination (due to the Maslansky act, resulting from the resolution of the US senate to terminate individuals involved with the unjust arrest of Sen. Leila De Lima), the president’s action of scrapping VFA will result to consequences of losing any defense assistance that does not only limit to military support, this includes disaster and calamity aid as well as counter terrorism assistance. That being said, the consequences will have a huge impact, considering the latter played a big part in cracking down terrorist activities the past.

The incident happened in Rizal province back in July 2019 wherein the police officers said the child was used as a shield by her father, who was also shot dead. Although whether it is true or false that both the father and child had drugs with them, dispatch noted that police tend to manufacture sometimes the scene and plant drugs in order to justify their mistake. It is unfair for all the lives taken away by the government, whether they are guilty or not guilty on the war of drugs because it is stated in the constitution that no person shall be “deprived of life” without due process of law and many of the victims of the war on drug were either accidentally killed by the police or were planted to be guilty.

The following news article exhibits the ff:
No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. (Section 1, Art. III, 1987 Constitution)
In this article, it talks about how Myka Upina, 3 years old, is the youngest victim of Duterte’s drug war.
In the following article, the President as Chief Executive mobilizes two institutions: the Department of Health to distribute face masks and the Department of Trade and Industry to monitor the prices of face masks, in fulfillment of Section 2 of RA 10121: “[to] provide maximum care, assistance and services to individuals and families affected by disaster.”
This illustrates Article 17, Section VII of the Constitution: “The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed.”

Constitutional law principle described: No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. (Section 1, Art. III, 1987 Constitution)
News event: Palparan guilty of kidnapping UP students Empeño, Cadapan (https://www.philstar.com/headlines/2018/09/17/1852264/palparan-guilty-kidnapping-students-empeo-cadapan)
Explanation:

On January 15, 2020, President Rodrigo Duterte declared the island volcano to be off limits for safety measures.

Retired Army general Jovito Palparan Jr. was found guilty of kidnapping and illegally detaining UP students Karen Empeño and Sherlyn Cadapan in 2006.

Because of his order to evacuate everyone on the island, there is a 100% assurance that no looting would be done because of an urgent matter by setting it as off-limits for the safety of everyone.
