For the Supreme Court oral arguments today Feb. 2 at 2:30 pm on the Anti-Terror Act : Laymanizing the so-called “war on terror” transposed into the law on armed conflict to justify the aggressive engagement of suspects (and of everyone) based on assigned status as combatants and not based on any of their overt acts under criminal law

      How to laymanize that:

      Just in case the other side invokes the domestic law of other countries in justifying the terror law:

      Copying the domestic law of other countries
and using that as justification in the Supreme Court oral arguments is like saying:

      “The U.S. Bush administration used the U.S. Patriot Act, the “war on terror” , transformed the figurative “war” of their “war on terror” — into the literal war (“guerra”, armed conflict) under the law on armed conflict
to justify the extraterritorial warrantless grabbing of foreign nationals from foreign territories
based on their status — or unilaterally assigned status — as combatants, under the law on armed conflict, and not based on any ongoing overt act of crime governed by existing laws … and thereafter, extraterritorially detaining them without charges in Guantanamo and subjected to water boarding —- because they did that, we can copy the terms of the U.S. Patriot Act and other domestic laws of other countries. ”
        Or…
it is like saying, “The U.S. Bush administration thereafter issued an executive memo justifying the practice of water boarding (as “enhanced interrogation technique”, i.e., torture), therefore, we can copy the domestic issuances of other countries”

         The domestic law of other countries is  not  a source of law in international law (most especially when they contravene peremptory norms of international law)
