tell you what: let’s argue both sides to be fair to everyone:
For the prosecution: that the photos were taken openly, by a non- law enforcement person, and also therefore the parties knew they were being photographed, therefore, can be admitted in evidence;
For the defense: that the photos were taken surreptitiously by a law- enforcement agent, and also the parties did not know, therefore did not consent, therefore, can be rendered inadmissible.
