Case Studies of Red-tagging Correlating with Actual Killings of the Subjects Red-tagged and the Legal Argument and Social Imperative for Prohibiting Red-tagging as Hate Speech under International Law” by Marichu C. Lambino

ABSTRACT: Thirty-nine killings of indigenous community schoolteachers, farmers, human rights workers, environmentalists, urban poor, cultural workers, professionals (lawyer, journalist, medical doctor, health worker) in 2016-2022 were preceded by non-stop red-tagging, red-baiting, and a smear campaign against them from known pro-government and pro-PNP trolls in social media, outdoor street media, and in other avenues. The subsequent killings of the subjects of red-tagging campaign correlates directly and indirectly with the methodical red-tagging campaign against them – thus, making red-tagging a form of violent incitement outside of the protection of the free speech guarantee. Based on said empirical data and on international law conventions including the International Covenant on Civil and Political Rights and the teachings of the most recognized authorities in various countries under Article 38 of the Statute of the International Court of Justice, this study builds the argument that red-tagging is a form of hate speech not circumscribed by the mantle of free speech protection and not tolerated under international law, and as such, should be criminally prohibited under national/ municipal law as violent incitements and hate speech.
