(wait, oops, breaking news, there’s an on-going live press con by PNP Chief Avelino Razon, but it went on after i posted this, he might discuss the evidence there, i think as instructed by DILG Sec. Ronaldo Puno;  but i already wrote this)

(breaking news, okay, this is on-going, the caption said he showed a photo of “Isnaji, company counting ransom money.)

On whether there is a prima facie case against Mayor Isnaji and son for the kidnapping of  Ces Oreña-Drilon and her news team: this blog said yesterday that the blog admin  needed to see the evidence to give an opinion. That hasn’t been disclosed to the public, there’s a preliminary investigation set.  (i’ll discuss criminal procedure when i have nothing to write about, hahaha.)

Of the publicly known “evidence”, this should be the bugging, puzzling, perplexing, has-to-be-resolved-or-else-we-will-have-insomnia question: (drumroll). (more drumroll):

You said that the kidnappers were Abu Sayyaf. Yes? Yeeess.

You said that Mayor Isnaji masterminded the kidnapping. Yes? Yeeesss.

You said that…Mayor Isnaji is a central committee member of the Moro National Liberation Front (MNLF). Yes?…Yeeess…

Then…if the kidnappers, as you confirmed, were  Abu Sayyaf, and Mayor Isnaji, as you said, masterminded the kidnapping, and Mayor Isnaji is a top leader of the MNLF, then the kidnappers were….(drumroll please. I want a drum roll and parallel directional lights  here):

the MNLF?????? (i want a hush to fall here)

An MNLF group posing as Abu Sayyaf?????? (i want murmuring from the audience here.)

An MNLF group who had recruited the young sons of Abu Sayyaf leaders and have turned them into….MNLF fighters??????? (Silence. I want a zoom-in on the “resource person’s” face).

I can’t hear your answer. Answer the question. Your Honor, instruct the witness to answer the question. Answer the question. If you don’t, you will be cited in contempt of court and detained…in the airconditioned staffroom until you answer. Answer.

(i have nothing to write about on this except that “curiouser and curiouser” question (with apologies to Lewis Caroll). NO ONE’S ASKING IT!!!! I’ll wait for the evidence to be publicly disclosed, in the meantime, shouldn’t someone ask that question of the publicly known evidence?)

UPDATE: The evidence has been disclosed in that press con (see breaking news above). NOBODY ASKED THE QUESTION!

  1. THE EVIDENCE ARE BASELESS..THE PHOTO JUST SHOWING ISNAJI, VICE GOVERNOR LADY ANN SAHIDULA AND HER BODYGUARD AND SOME GOVERMENT OFFICIALS..IT DOES NOT SHOW ALVAREZ ISNAJI TOOK THE MONEY….AND WY NOT CHARGE ALL THOSE INT HE PICTURE?…OTHER EVIDENCE ARE MERELY HEARSAYS..THE ONLY WITNESS IS QUIDATO(SAID AS AN UNDERCOVER PNP OFFICIAL)..HE WAS THE ONE WHO SAID THAT ISNAJI TOOK THE 3 MILLIONS..BUT WHERE IS THE EVIDENCE?WHY pUNO AND rAZON CANNOT CLARIFY MORE ON THEIR EVIDENCE AGAINTS THE ISNAJI’S?…MY ONLY CONCLUSION IS THAT ISNAJI’S ARE THE VICTIMS OF A POLITICAL CONSPIRACY…THE ELDER ISNAJI IS THE HERO IN THE KIDNAPPING CASE…THIS IS WHAT GMA AND HER gUBERNATORIAL CANDIDATE ALLY ZALDY AMPATUAN CANNOT ACCEPT..BECAUSE IF ALVAREZ ISNAJI CONSIDERED AS A HERO..THEY MAY LOST THE ARMM GUBERNATORIAL RACE..SO THEY HAVE TO HUMILIATE AND DEGRADED ISNAJI SO THEY CAN WIN THE ELECTION…( THE ARMM GOVERNOR SUPPOSED TO BE FROM MNLF MEMBER-ACCORDING TO 1996 PEACE TREATY BETWEEN GRP AND GOVERMENT )…BUT I AM OPTIMISTIC THAT ISNAJI’S WILL BE FREED BECAUSE GOD WILL HELP THOSE ARE OPPRESSED…

  2. Ces et. al should thank the Isnaji’s for saving their a**.This Include the Filipino people and the Goverment. The Isnaji’s had been instrumental in releasing the kidnap victims. It was not the PNP and DILG.But now the PNP and DILG wants to show the filipino people that they had their part and working hard…just by making the Isnaji’s as a scapegoat and arresting them. They know they cant arrest the ASG’s in the Jungle. So the best and quick way(to show us that they are doing their job) is by arresting the Heroes.
Puno and Razon are new in politics and doesn’t care about the peace and stability in the Southern Phils. We had a great leader like Ramos and Aquino who are intelligent (unlike Puno and Razon) and peace loving.
To appease a crying baby is to feed them…not to kill them..the same goes to the Rebels in the South.Manila should bring development to these places. These people are doing criminal things because they are hungry..and no one wants to help them.
I dont think the Isnaji’s are guilty, based on the news that i read couple this days..may justice prevail

  3. How bobo naman this government trying to implicate the Isnaji’s with a mere picture. The picture doesn’t even portray Mayor Isnaji counting the money. You know if a person really want to stash away money, he will not count the money in front of everybody to include the vice governor of Sulu. And Ms. Lambino never maliciously implicate the MNLF organization because you are talking of Mujahideens who are the soldiers of Allah (s.a.w.) May you be cursed by Allah (s.a.w.) for pinning the MNLF with malicious comments of yours. Isnaji and his son are innocent.Plain and simple logic. Why? They wouldn’t exchange the prestige of their family for only P3milion. Isnaji’s owned the land more than half of Indanan municipality. If they want P3million they could just offer their land porperties as collateral in the bank and they could even get more than that amount. The problem with this government just to cover up for their corruptions and deceptions, they always use Muslims to cover it up. As regards to the Regional Governor of ARMM and his father, how shameful for them to create large Mosques in their mansions and destroy MNLF leaders when the money they spent are the blood of the MNLF Mujahideens. May you be cursed by Allah (s.a.w) and may it be soonest possible. Have you forgotten the Holy Qur’an, it says: “Allah always has the appointed time for punishment, when it comes even your millions cannot stopped it from His bringing down your punishment.”

  4. Dear Ms. “Elvira Brent”: i was surprised to read your letter (see widget). I’m waiting for the evidence, like any discerning lawyer watching these events. The series of questions i asked there, Ma’am, (blog post :

(w/ belated breaking news update) Of the publicly known allegations: On Mayor Isnaji and the kidnapping in Sulu )

was an illustration of how to “pin down” the police, and PNP Chief Avelino Razon. They’re cross questions (cross questions are cross examination questions; cross examination questions are usually leading questions, they make the witness say “Yes” to certain allegations then the series of “Yesses” would show the lack of logic of the witness in arriving at his/her conclusions) they “pin down” the lack of logic of the police—when i asked there: First you (the police) said it was the Abu Sayyaf, yes? Yeess; now you (the police) said it was the MNLF? The theory of the police lacked logic. Then i even finished by saying “curiouser and curiouser” quoting from Lewis Caroll’s Alice in Wonderland. Since you cursed me in your comment for something i did not do, I would appreciate an apology, pero okey lang if it is not given. I’d want readers to see this. Here’s one more tip or suggestion (aside from those series of cross questions that show the lack of logic of the police): the photos could be expunged from the evidence and rendered inadmissible; inadmissible means they cannot be used in evidence against the Isnajis. It means the Court can be compelled to ignore those photos if they are rendered inadmissible in evidence. Thank you for writing.

  5. Thank you ms. Lambino for giving us insight on the Isnaji’s Case.We will follow this case till the end…i hope Ms. Lambino will continue to give us your knowledge on law and discuss with us..I want to ask Ms. Lambino and hope you will reply…If you are the attorney of the Isnaji’s, then what would you argue to the prosecutor?

  6. Dear Jack,

tell you what: let’s argue both sides to be fair to everyone:

    For the prosecution: that the photos were taken openly, by a non- law enforcement person, and also therefore the parties knew they were being photographed, therefore, can be admitted in evidence;

For the defense: that the photos were taken surreptitiously by a law- enforcement agent, and the parties did not know, therefore did not consent, therefore, can be rendered inadmissible.

(I try not to write a full legal opinion for the blog — it’s free. Thanks for stopping by and writing!)

    Regards.

  7. Ms. Lambino,
Thank you so much for the free legal advice…i want to ask another questions (hope you dont mind)…in a press release today, the PNP and DILG filed their charges just by Quidato’s statement. The Kidnap victims didn’t say anything about the involement of the isnaji’s…Is it enough to convict the Isnaji’s?Considering that Quidato is a police officer? And, If for instance the Isnaji’s are found not guilty, can they sue back their prosecutors?
