Law on Mass Media Bonus Exercise 10 pts (deadline 11:59pm)

     Because of the results of the third exam, the following is a bonus practical exercise for ten points (please type your answers in the comments section of this post)    :

     1)Define defamation under the libel law in the national language, Filipino (ibigay ang kahulugan ng “defamation” sa ilalim ng batas sa libelo, gamit ang pambansang wika)

     2)Applying this definition, give an example of any “fair comment” (a sample of a minimum of ten words, in English or Filipino), whether your own or by any “commentator”, directed at any person involved in the quo warranto proceeding being resolved at the Supreme Court en banc today.

     3)To justify your categorization that this is a form of fair comment, enumerate at least five subjects of fair comment (of the ten non-exclusive list discussed in class), then state the criteria or standards of fair comment.

     This bonus post is time-bound: the deadline is 11:59pm today May 11, 2018 (or before midnight today).

     The fourth and last exam will push thru as scheduled.

    Criteria of Fair Comment
    – Opinion must be on a matter of public interest or on valid subjects
    – Opinion must have some basis in fact
    – Must be the commentator’s honest opinion

    Self Definition: Defamation o ‘paninirang puri’ ay isang uri ng Krimen na walang katotohanan at walang basehan na pag-aakusa ng isang krimen, bisyo, pagkukulang, kalagayan, at sirkumstansya. Ang paninirang puri ay nakakasira ng dignidad, nakakahadlang sa tamang pagtamasa ng hustisya o nakakasira ng reputasyon at imahe ng isang tao.

    PUBLIC OPINION: The comment’s subject are public government officials who are currently involved in the popular and and much debated Ousting of Former Chief Justice Maria Lourdes Sereno.”
    BASED ON TRUTHS AND FACTS: It is factual that Sereno was ousted from position as Chief Justice through quo warranto which my definition according to Atty. XAVIER BECERRA, of the State of California Department of Justice,

    Quo warranto is a special form of legal action used to resolve a dispute over whether a specific person has the legal right to hold the public office that he or she occupies.

    “Quo warranto is used to test a person’s legal right to hold an office, not to evaluate the person’s performance in the office. For example, a quo warranto action may be brought to determine whether a public official satisfies a requirement that he or she resides in the district; or whether a public official is serving in two incompatible offices.her impeachment”

    and not through the impeachment case she has been battling in the last few years.

    CONCERNING PUBLIC OPINION/INTEREST: The topic of the comment is of public opinion and protecting public interest. Many UP students share the same sentiments as Leslie Yasis, seen through various facebook quotes, online comments and the Indignation Rally of students from UP Diliman, Merriam College and Ateneo today.
    NO IMPUTATIONS: There were no false accusations made towards specific individuals.
    NOT ILL-WILLED, NOT MADE IN SPITE: It was an expression of how she feels about the ousting of former CJ Sereno, seeing it as a form of injustice because she feels it was done with lack of basis.
