Nominations should now be submitted for the 3 vacant posts in the U.P. Board of Regents

         News peg: From Rappler: “U.P. Board of Regents withdraws recommendation to reappoint Spocky Farolan xxx Following the controversial Facebook post of University of the Philippines (UP) regent Frederick “Spocky” Farolan, the UP Board of Regents revoked its recommendation for his reappointment.” (Statement of the U.P.        In other words, presidential appointee Atty. Spocky Farolan is in a holdover capacity at the U.P. Board of Regents, his term having expired last month (appointment paper dated October 28, 2016 for a term of two years, with oath of office administered November 11, 2016).
      In government agencies, the so-called holdover principle is sometimes applied in order to “preserve continuity in the transaction of official business”. In business corporations, it is also sometimes applied for quorum purposes of the board of directors. In other words, the holdover principle is applied only for practical purposes — but legally, the post itself requires a new appointment and is technically vacant.
       Presidential spokesperson Sal Panelo said that an investigation should first be conducted to get the side of Atty. Spocky Farolan — perhaps not being aware that such has already been made by the U.P. Board of Regents when it considered the explanation of all parties concerned during its meeting yesterday. Pañero’s suggestion is an attempt to dribble the ball – a feat better left to the Ateneo Blue Eagles whenever they get exhausted from harassing UP Maroons Team Captain Paul Desiderio … (#UPFight , oops, sorry, couldn’t resist that). MORE IMPORTANT, the post is already vacant, terms have expired, there is no standing appointment in favor of anyone, no one has any claim to the post anymore, nominations should now be submitted, and Malacañang should now be in the process of receiving nominations for ALL THREE VACANT POSTS OF THE U.P. BOARD OF REGENTS (yes, there are three whose terms have expired last month) if the Malacañang Office of the Executive Secretary were to do its ministerial job efficiently.
                Or better yet, the U.P. community should now be submitting nominations. Or better yet, the U.P. administrators should now gather nominations, or announce that nominations may now be submitted, informing Malacañang of such fact as well.

              Why isn’t anyone proactive? 

             Leave the dribbling to the Ateneo Blue Eagles when they’re not tripping and shoving UP Maroons Center Bright  Akhuetie from the back #UPFight.

A Statement from the UP Board of Regents (copy-pasted from the U.P. Diliman twitter site)

     The Board of Regents of the University of the Philippines takes note of the apology of Regent Frederick Mikhail I. Farolan during the Board of Regents meeting today regarding his post on social media that appeared to advocate the use of violence against members of the men’s basketball team of the Ateneo de Manila University.

      We dissociate ourselves as a Board from Regent Farolan’s statements and actions. Whatever his motives may have been, there is no excuse for sowing fear and confusion, especially at a time when the University’s attention should have been focused on the rising successes of its athletic program. We view with extreme disapproval and strongly condemn violence in any form.

       The Board continues to uphold the principles of civility and sportsmanship. All Regents, officials, and members of the UP community are expected to keep with the highest standards of decorum.

     We apologize to the officials, staff, and athletes of the Ateneo de Manila University and to the UP community for any anxiety Regent Farolan’s statements may have caused.  We also deeply regret the dampening of the euphoria of UP reaching the UAAP finals.

        Committed to a higher standard of accountability for its members, the Board hereby withdraws its recommendation for the reappointment of Regent Farolan to the Board of Regents. We enjoin Regent Farolan from making any such further statements which can compromise the reputation and the goodwill of the University.
